1. General Conditions
Rare Leaf Market sells live ornamental plants and related products through international shipping.
We reserve the right, subject to applicable law, to:
- Refuse service or cancel an order where reasonably necessary, including in cases of suspected fraud, regulatory restrictions, or inability to fulfill an order.
- Modify, suspend, or discontinue any part of our services.
- Update these Terms & Conditions from time to time.
2. Eligibility
By using this website or placing an order, you confirm that:
- You are at least the legal age required to enter into a binding agreement in your jurisdiction.
- You have the legal authority to enter into this agreement.
- You are responsible for complying with applicable local laws, customs requirements, and plant import regulations.
3. Product Information
We make reasonable efforts to display our products as accurately as possible. However, because our products are live plants:
- Plant size, shape, coloration, leaf count, variegation, and overall appearance may vary.
- Product photographs are provided for reference purposes.
- Minor cosmetic differences are natural and should be expected.
Rare Leaf Market does not guarantee that a delivered plant will be identical in appearance to the plant shown in product photographs.
4. Pricing & Payment
- All prices are listed in USD unless otherwise stated.
- Prices may change without prior notice.
- Full payment is required before an order can be processed.
We reserve the right to cancel, refuse, or correct an order where there is a pricing error, product availability issue, suspected fraudulent activity, payment issue, or other reasonable operational concern.
If Rare Leaf Market cancels an order that has already been paid and the cancellation is not caused by the customer, the applicable payment will be refunded in accordance with our Refund, Cancellation & Claim Policy.
5. Order Processing and Cancellation
Once payment has been successfully completed, the order is considered confirmed and processing may begin immediately.
Cancellation requests are subject to our Refund, Cancellation & Claim Policy.
Depending on the processing stage of the order, a cancellation fee of 5% or 10% of the applicable order amount may apply.
Orders that have entered the packing process or have already been shipped cannot be canceled.
Estimated Processing Time
Our estimated order processing time is approximately 1–2 weeks and may include:
- Export permit processing.
- Plant health or laboratory inspection where required.
- Phytosanitary certification.
- Packing and shipment preparation.
Processing times are estimates only and may vary depending on inspection results, document processing, weather conditions, plant condition, order volume, government procedures, or other operational circumstances.
6. Shipping & Delivery
Shipping is subject to our applicable Shipping Policy and the terms of the selected courier or shipping provider.
Estimated delivery time after dispatch is generally:
- Approximately 4–7 days after dispatch, depending on the destination country, customs clearance, and courier service.
Rare Leaf Market is not responsible for delays caused by circumstances outside our reasonable control, including:
- Customs clearance or inspection.
- Weather conditions.
- Courier delays or transportation disruptions.
- Government inspections or regulatory procedures.
7. Export Compliance — Indonesia
Rare Leaf Market prepares export shipments in accordance with applicable Indonesian export and plant quarantine requirements.
Depending on the type of plant, destination, and applicable regulations, export procedures may include:
- Required export documentation.
- Plant health or laboratory inspection where applicable.
- Phytosanitary inspection and certification.
If a plant does not meet an applicable inspection requirement, additional inspection, treatment, replacement, documentation, or processing may be required. This may extend the estimated processing time.
8. Inspection Responsibilities
- Rare Leaf Market is responsible for arranging the export inspections and certifications within Indonesia that are included within the agreed scope of our service.
- After the shipment leaves Indonesia, import requirements, permits, inspections, and regulatory compliance in the destination country are the buyer’s responsibility unless expressly agreed otherwise.
9. Import Responsibility
Buyers are responsible for ensuring that the plants they purchase may legally be imported into their destination country.
Buyers are responsible for:
- Confirming that the ordered plant species are permitted in their country.
- Obtaining any required import permits.
- Providing accurate recipient, shipping, and import information.
- Complying with applicable local import, customs, quarantine, and agricultural regulations.
If a shipment is rejected, delayed, confiscated, returned, or destroyed due to prohibited plants, missing buyer-provided permits, incorrect customer information, or failure to comply with destination-country import requirements, Rare Leaf Market is not responsible for the resulting loss to the fullest extent permitted by applicable law.
10. Taxes & Duties
Unless expressly stated otherwise, all taxes, customs duties, import fees, inspection fees, clearance fees, brokerage fees, or other government charges imposed by the destination country are the responsibility of the buyer.
11. Shipping Instructions
Buyers are encouraged to provide any specific shipping or documentation instructions required by their destination country before the shipment is prepared.
If no special instructions are provided:
- Rare Leaf Market will use its standard shipping and export preparation procedures.
- The buyer remains responsible for destination-country requirements that fall outside Rare Leaf Market’s agreed scope of service.
12. Plant Condition & Natural Risk
Live plants are sensitive products and international transportation involves unavoidable natural risks.
Plants may experience temporary effects during transportation, including:
- Transit stress.
- Minor leaf damage.
- Yellowing or leaf drop.
- Temporary dehydration.
- Minor cosmetic deterioration.
These conditions may be considered normal risks associated with transporting live plants internationally and do not automatically qualify for a refund or replacement.
13. Refund, Damage & Claim Policy
All cancellations, refunds, Dead on Arrival (DOA) claims, replacements, and related claim requirements are governed by our Refund, Cancellation & Claim Policy.
Damage or DOA claims must be submitted within 24 hours of delivery and must include clear photographs, videos, and other required evidence.
Submitting a claim does not automatically guarantee a refund, replacement, or other compensation. Claims are reviewed based on the evidence provided and the applicable policy.
14. Shipping Capacity
Rare Leaf Market may process approximately 80–100 shipments per week, depending on operational capacity.
During periods of high demand, orders may be placed in a processing queue. Estimated processing or dispatch dates are not guaranteed unless expressly confirmed in writing.
15. Dispute Resolution
Rare Leaf Market is committed to fair and transparent communication when resolving customer concerns.
Customers are encouraged to contact us directly and provide us with a reasonable opportunity to investigate and resolve any issue before initiating a payment dispute or chargeback through a bank, credit card provider, PayPal, payment processor, or other third-party service.
A payment dispute or chargeback may affect our ability to process a simultaneous internal refund or claim while the payment provider is reviewing the transaction.
16. Import Permits
Buyers should obtain and provide valid import permits when required by the laws or regulations of their destination country.
Failure to provide required documentation may result in customs delays, shipment rejection, confiscation, return, or destruction of the plants.
17. No Minimum Order
Unless otherwise specified for a particular product or service, Rare Leaf Market does not require a minimum order quantity. Customers may purchase according to product availability and applicable shipping requirements.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Rare Leaf Market is not liable for loss, damage, delay, or additional costs resulting from circumstances outside our reasonable control, including:
- Customs delays or regulatory actions.
- Courier or transportation disruptions.
- Weather conditions or natural events.
- Improper handling or plant care after delivery.
- Failure by the buyer to comply with applicable import regulations.
To the fullest extent permitted by applicable law, Rare Leaf Market’s aggregate liability arising from an individual order will not exceed the amount actually paid by the customer for the affected order.
Nothing in these Terms excludes or limits rights or liabilities that cannot legally be excluded or limited under applicable law.
